This is a bonus law that gives you a 30% of beating your ticket before going to court.  (other sites claim that this is some sort of secret, it isn't, it is written on the California ticket as an option)

2. Only put this in your declaration.

 

"I was not speeding and did not exceed the posted speed limit. The radar gun or laser gun probably was not functioning correctly."

 

DO NOT: put anything else. The trial by declaration allows you your first shot by mail. If you are unsatisfied with the result you are still entitled to a trial and guaranteed on. The caution is that anything you put on the declaration can and will be used against you in court. There is a 30% chance that the arresting officer will not respond and in that event your ticket is thrown out.

 

You are taking advantage of the fact that in California cops receive between $200 and $300 for a court appearance and $-0- for filling out the trial by declaration forms. The average is that 30% do not fill out the forms. That is your 30% divine intervention factor. However it can also be a trap if you admit to speeding or any speed above the speed limit. Only use the words I wrote above or something similar.

 

If the courts decision is unfavorable to you or you don't like it you are still guaranteed a trial. You lose nothing by using this option, provided you do not admit to exceeding the speed limit.
